had proper ID . . . and law enforcement did not contact you?
This is what happened to Debra Fountain and I [Judy Bragg Pardo] when our sons died.

I would like to add, my son had a son. Law enforcement never contacted the family!When we complained to Florida Orange County Sheriffs Office (OCSO) that we were not notified by law enforcement of our son's deaths; their written responses to us claimed no wrong doing. Both of our written responses read: "The officers DIDN'T BREAK ANY STATUTES."
Most Sheriff / Chief of Police / Florida Highway Patrol agencies have it in their procedures they are to notify next of kin. All say it is their job. We requested OCSO procedures, it clearly read the officers were to notify next of kin. The officers needed more training in notification; they did not get it. Procedures do not work! That is why we need it to be a law.
So that this does not happen to any future families, we want to make it a law in the State of Florida to define law enforcement is to notify next of kin.
All citizens are entitled to be notified by law enforcement if the loved one had proper ID on him/her.
This is a sample of the bill filed in 2006 by House Rep. Matt Meadows (not currently sponsoring the bill) and how Debra and I would like it to read:

Because Debbie and I stood up for what we believe in and our persistence, OCSO revised their Notification Next of Kin policy to be more detailed.

I consider this a birthday gift as it became effective on my birth date (not intentionally, of course). We thank OCSO for that,
but it is still a policy-the other policy clearly stated they were to notify. PSD would not explain to us why their
written statements claimed no wrong doing.

Model Policy was disbursed to most sheriff and municipal so those law enforcement agencies could adopt if
they did not have one or add to the existing one.

which can only be retrieved by a police officer. This came about as a result of one woman's teenage daughter
being killed in a car accident and taking over 5 hours to locate the mother to inform her. This way, if you are in

Have a cell phone? Plug in "ICE"!
That is, "In Case of Emergency." Several agencies have been pushing a British idea that can help locate your
friends and family if you get in an accident. Program in the letters I-C-E as a contact in your cell phone. Then, under
that contact name, save the number you would want emergency workers to call if something happened to you. If you carry
a cell phone, this is the first place law enforcement looks for a family member.
Next of Kin Registry
The Next Of Kin Registry (NOKR) was established as a FREE tool for daily emergencies and national disasters. NOKR is an emergency contact system to help if you or your family member is missing, injured or deceased. NOKR provides the public a free proactive service to store emergency contacts, next of kin and vital medical information that would be critical to emergency response agencies. Stored information is only accessible via a secure area that is only accessible by emergency public trust agencies that have registered with NOKR.

Orange County Citizen Review Board (CRB)
Since our complaint was procedural, we were not able to be seen at the Citizen Review Board.
In both our response letters, the OCSO Professional Standards Division (PSD) sergeant wrote, "IF YOU HAVE ANY QUESTIONS, TO CALL HIM."
HOW PSD TREATED US, CITIZENS. . . I called PSD and asked to come in to talk about their responses to our complaints, as we did not understand how they came to the conclusion of no wrong doing as the procedures clearly read they were to notify the next of kin. The head of PSD told me, "NOT TO COME IN, THERE WAS NOTHING TO TALK ABOUT, THE CASE WAS CLOSED."
So why tell us to call if we have questions?
All it did was to look good on paper for them.
Seven months later, Debra and I also complained of how OCSO Professional Standards Division TREATED US- after writing in our responses to call if we had any questions, we wanted to come in and talk, and we were told by the head of PSD, "NOT TO COME IN, THERE WAS NOTHING TO TALK ABOUT, THE CASE WAS CLOSED."
Debra and I feel this was abuse of power and authority. The complaint of how we were treated went right back to PSD and THEY decided it does not constitute to be seen in front of CRB.
I feel PSD abused their power/abused their position. Personal gain of power and fill their own ego of PSD of not having to do anything they do not want to do even going against what they wrote about having questions. They abused their authority and infringed upon our rights as citizens with the way they treated us.

The Citizen Review Board reviews citizen complaints of excessive force and abuse of power that the Orange County Sheriff's Office receives. The Sheriff's Office has a section in their procedures that states information about the CRB, including using the terms excessive force and abuse of power. The CRB members are given a matrix that helps define excessive force, but abuse of power has no clear written definition in the Sheriff's procedures nor is there a definition in the CRB Charter.
According to the Sheriff's Office, abuse of power is the same as abuse of position. Abuse of position is defined in the OCSO Standard Operation Procedures, but abuse of power is not. Nor does the term abuse of power have any written connection to the term of abuse of position. There is only assumption that it means the same thing.
Legal documents/something as important as the Sheriff's procedures should not have assumptions. This leaves HOLES in their procedures!
The following is the definition of abuse of position:
OCSO 341.0
27. Abuse of Position (Category 9)
Personnel shall not use their official position, authority, title, or identification for personal or financial gain for themselves or their associates. Exceptions are agency pay and benefits and off-duty employment that is conducted consistent with General Order 360.0. Personnel shall not use their official position, authority, title, or identification to infringe upon a person’s civil rights or to otherwise violate the law.
So that it is clear to not only the Sheriff's employees, CRB members, but mostly to citizens who may have complained of abuse of power...I suggested to the Sheriff's Office to clarify abuse of power-have a written connection to abuse of position. My suggestion was to have it to
read:
OCSO 341.0 27. Abuse of Position/Abuse of Power
This way there IS a written clear definition between the two.
I was told by Professional Standards Division that it was not necessary to add abuse of power, that the words were exchangeable and that they were not going to make any changes/addition.
NOW my next step will be to approach the Orange County Charter Review Commission next year concerning this matter and suggest the term abuse of power be defined in the CRB Charter.

Sheriff Kevin Beary announced that the the Orange County Sheriff Office changed the term, "abuse of position" to "abuse of power" in their procedures:

for citizens and Citizen Review Board members.
The term in the Orange County Charter now is the same term
in the Orange County Sheriff's Office.******
